Appeal from Trial Term, New York County. Action by W. Wallace Grant against Pratt & Lambert. From a judgment for defendants, plaintiff appeals. Reversed. See 65 N. Y. Supp. 486.

This is the second appearance of this case in this court. On the former trial a judgment was directed by the court in favor of the plaintiff for the full amount of .the plaintiff’s demand. Upon appeal to this court the judgment was reversed, and a new trial granted. 52 App. Div. 540, 65 N. Y. Supp. 486. The facts in the casea were fully reviewed in the opinion delivered upon the former appeal, and it is not necessary that they be now restated.
