Appeal by plaintiff from an order of the municipal court of Minneapolis, Mahoney, J., denying a motion for a new trial.

Plaintiff was the owner of a certain store building,, which he leased to defendants for three year’s from the first day of July, 1890, at a rental of $75 per month, in advance. The lease expired on the last day of June or first day of July, 1893, and defendants continued in possession until the first day of September, 1893. This action is' brought to recover rent for the balance off the year commencing July 1, 1893, on the theory that by remaining in possession after the end of the three-year term the defendants became tenants for another year.
