1. The Western Union Telegraph Company brought suit against the Town of Dexter and others, to enjoin the collection of an annual occupation tax of $5 imposed upon the telegraph comjiany by the town. The case was submitted to the trial judge for decision without the intervention of a jury; and he heard and determined all issues of law and fact.
