Appeal from a judgment of the Supreme Court, Erie County (Joseph S. Forma, *1277J.), rendered December 17, 2002. The judgment convicted defendant, upon a jury verdict, of burglary in the first degree, rape in the first degree and attempted robbery in the second degree.
It is hereby ordered that the judgment so appealed from be and the same hereby is unanimously affirmed.
