Appeal from a judgment of the County Court of Albany County (Keegan, J.), rendered November 5, 1990, upon a verdict convicting defendant of the crime of criminal sale of a controlled substance in the third degree.

Defendant was indicted for and convicted of criminal sale of a controlled substance in the third degree. He was sentenced as a second felony offender to an indeterminate term of imprisonment of 12 Vi to 25 years. On this appeal, defendant contends, inter alia, that the People failed to establish beyond a reasonable doubt each and every element of the crime charged. We disagree.…
