This is au action of covenant instituted in the Circnit Court of Hillsborough county, by Johnson the appellee, against *199Hooker the appellant. The declaration sets out m Jmo verba,the instrument sued upon, which contained divers and numerous covenants to be performed by the pai'ties respectively. It also avers a full performance by theplaintiff and complained that the defendant had failed to perform the covenants stipulated to be performed on his part, and set forth specially the several breeches complained of.
