Appellant was convicted of murder and his punishment assessed at twenty-five years confinement in the State penitentiary.

Appellant was a boy seventeen years of age, attending the Newport public school. Deceased, J.G. Wright, was the teacher in charge of the school. Appellant handed in a composition, written in part in his handwriting and in part in the handwriting of a young lady. On the day of the homicide deceased was criticising this paper; said he was going to give no grade on it, and that he was going to report the matter to the pupil's parents.
