STATEMENT OF THE CASE
The matter before the Court is a civil rights action filed under 42 U.S.C. § 1983 by plaintiff Pella, an inmate at Northern Nevada Correctional Center (“NNCC”). Pella alleges that the three-member disciplinary committee at NNCC violated his constitutional due process rights when they found him guilty of ingesting marijuana. He argues that the defendants, the members of the disciplinary committee, did not have sufficient evidence to find him guilty because the urinalysis test relied on by them was scientifically flawed.
