Appeal from a judgment of the Supreme Court (Lamont, J.), rendered June 10, 2011 in Albany County, convicting defendant upon his plea of guilty of the crime of burglary in the third degree.
In satisfaction of a three-count indictment, defendant pleaded guilty to burglary in the third degree and waived his right to appeal. Under the terms of the plea agreement, he was to be sentenced as a second felony offender to 2V2 to 5 years in prison.
