HARDBERGER, Justice.
This attorney’s fees case is a prime example that litigation is an expensive sport.
The underlying case was an ingress/egress easement dispute. The appellants, the Herrings, filed a declaratory judgment suit claiming that the two groups of appellees did not have the right to use the easement to get to their property. This roadway easement crossed the Herrings’ property. It was the unique position of the Herrings that the ap-pellees could build and maintain the roadway, but not use it.
