The plaintiff in this case was city surveyor of Utica, an officer of the corporation defendant. Having accepted and entered into that office, he must be deemed not only to have had notice of all the provisions of the charter, but also to have acted with reference to all its provisions relating to the services which he, in such office, might be called upon to render. In respect, therefore, to compensation for those services, there can be in his favor no implied assumpsit on the part of the corporation, except such as arises out of the provisions of the charter itself.
