In an action for divorce, plaintiff appeals from a judgment of the Supreme Court, Nassau County, entered October 19, 1972, which, inter alla, dismissed the complaint, upon a decision rendered at the close of plaintiff’s case at a nonjury trial. Judgment reversed, on the law, without costs, and new trial granted. The appeal did not present questions of fact. Plaintiff and defendant were married on December 2, 1951.
