Appeal and cross appeal from an order of the Supreme Court, Monroe County (David M. Barry, J.), entered December 2, 2004. The order, among other things, denied plaintiffs application for sole custody and granted defendant’s cross motion to enforce the judgment of divorce.

It is hereby ordered that the order so appealed from be and the same hereby is unanimously modified on the law by denying the cross motion in part, reinstating the application and vacating the first and third through fifth ordering paragraphs and as modified the order is affirmed without costs, and the matter is remitted to…
