It is clear from the evidence in this recdrd that the board of common council during the ytears 1868 and 1869 did not “keep a correct journal of its proceedings,” as required by the city charter *614of 1851. The books in the possession and custody of the clerk of-that board do not bear upon their faces the requisite evidence of authenticity. Besides it is clearly proved that they were written up long after the meetings the proceedings of which it is pretended are recorded were held.
