Appeal by the relator, Max Katz, from an order of the Supreme Court, made at the Kings County Special Term and entered in the office of the clerk of the county of Kings on the 2d day of March, 1915, quashing a writ of certiorari.

Carr, J.:

This is an appeal from an order vacating or quashing a writ of certiorari. The order was made at Special Term and was accompanied by a brief memorandum, in which the court stated that the relator had mistaken his remedy and should have applied for mandamus. The relator was appointed from the'eligible list of the civil service commission of the city of New York to the position of patrolman on the police force of the city of New York. The nature of his appointment is regulated by rule 11 of the rules and regulations of the municipal civil service commission. This rule does not appear…
