On September 16, 1965, the plaintiff, Paul Wall, filed the instant suit, an action in tort, naming as defendant Sun Insurance Company of New York. The petition alleged that the plaintiff’s truck, while being operated by one of his employees on June 26, 1965, was struck by a 1963 Chevrolet sedan being operated by one Ferdie Soileau.
