The defendant, Albert Samuels, was tried in the criminal court of Cook county on an indictment charging him with forcible rape said to have been committed on the person of Clara Carlis. On a trial before the court without a jury he was found guilty and sentenced to ten years imprisonment. He has sued out this writ of error.

Except for the direct assertion of Clara Carlis that the defendant raped her, and the defendant’s equally direct denial, there is no great amount of conflict in the evidence. Clara Carlis is the wife of George Carlis but was not living with him, except for an occasional…
