Tolub, J.), entered January 7, 2005, which, to the extent appealed from as limited by the briefs, dismissed the complaint as against defendant International House of Pancakes (IHOP) and denied the motion by defendant 1586 Northern Blvd. Co. for summary judgment on its cross claim for contractual indemnification against IHOR and order, same court and Justice, entered May 2, 2005, which, upon reargument, further granted 1586 Northern Blvd. Co.’s motion for summary judgment dismissing the complaint against it, unanimously affirmed, without costs.
