Evidence for the state tended to show that at approximately 2:30 a.m. on the morning of 21 August 1979, Officer W. K. Crisler saw a flatbed truck at the intersection of Fairview Road and Sardis Road in the city of Charlotte. The flatbed truck was stopped at a traffic light and was headed away from Charlotte. The police car also was stopped at the intersection, headed in the opposite direction.
