This is an appeal by plaintiff, Sun Life Assurance Company of Canada, hereinafter referred to as appellant, from an order granting a new trial to defendants, Ernest F. Cushman and wife, who will hereinafter be referred to as respondents. The order recites that the motion for new trial was granted upon the specific ground of misconduct of the appellant and of the jury.
