Riner, Justice.

In an action instituted by Neis Nastrom in tbe District Court of Carbon County against Louis Sederlin, tbe former recovered a judgment. Tbe record in tbe case is here for review by direct appeal, at tbe instance of tbe losing party below, who challenges tbe propriety of that judgment and some of tbe court’s rulings made in tbe course of tbe trial. Tbe parties will be referred to herein as plaintiff and defendant respectively.
