BueCH, J.:

The action was one to cancel a 99-year lease of real estate in the city of Hutchinson, executed by an agent of the plaintiffs, and for damages. The agent answered, and asked judgment for a commission for negotiating the lease. The lessee answered, and asked, in the alternative, for confirmation of the lease, or for specific performance of contract to lease. Other defendants answered, and judgment was -rendered for the plaintiffs, on the pleadings, ffor cancellation of the lease. The defendants affected by the judgment appeal.
