On an information charging that he did have in his possession about 3% gallons of corn whisky, with the unlawful intent to sell the same, C. L. Rose was convicted and his punishment fixed at imprisonment in the county jail for 30 days and a fine of $250. He has appealed from the judgment rendered upon such conviction.
