Appellee Trust Company is the assignee of the Excelsior Machine & Boiler Works, an insolvent corporation, by deed of assignment executed and filed December 28,1896; the other appellees were creditors of the insolvent, who were made parties defendant to the petition of appellant concerning which the order appealed from was made.
