' Appellant, Mrs. William Marks, was indicted for the crime of assault'with intent to kill alleged to have been committed by shooting Pauline Daugherty with a pistol. She was convicted and has been sentenced to a term of ten years in the penitentiary. The prosecuting witness is a young woman 19 years of age at the time of the trial. ■ ■■
