The appellant, James Howard, was indicted in the Franklin circuit court, for the murder of Mollie Howard, his wife; and he was convicted of murder in the first degree. He moved for a new trial, which was refused, and then in arrest of judgment, and the latter motion was likewise overruled.
The ground of the motion in arrest of judgment was: that the indictment did not charge the offense with sufficient certainty.
