McQUADE, Justice.
R. A. Harrison and Myrtle Harrison, husband and wife, brought this action against the State of Idaho and its employee, Jerald Pence, for personal injuries and property damage which are alleged to have been caused by the negligence of Pence. General Insurance Company of America, seeking to recover the amount it paid under an insurance policy to the Harrisons for damage to their automobile, was made a party plaintiff by intervention.
