THIS CAUSE came before the Court upon Defendant’s Motion for Summary Final Judgment (DE #21), and Plaintiff Pantropic’s Cross-Motion for Summary Judgment (DE # 33). 1 Upon consider ation of the Motions, responses, and the pertinent portions of the record, the following Order is entered.
