HOLMES, Judge.

In the present case the original bill for divorce was filed by the appellee-wife asserting physical cruelty as the ground. Simultaneously with the filing of the divorce an answer and waiver executed by the appellant-husband was filed, and an agreement signed by both parties was additionally filed with the register of the Circuit Court of Calhoun County, Alabama, along with additional appropriate documents. The date of the aforementioned filings was March 24, 1971.
