The complaint in this action, as fairly summarized by appellants’ counsel, alleges in substance that the plaintiff, Charles A. Ryder and the plaintiff, Edith C. Ryder, are husband and wife; that the plaintiff, Charles A. Ryder, on or about the 2nd day of October, 1921, and .the plaintiff, Edith C.
