Action by plaintiff, appellant here, to recover damages for alleged personal injuries. The verdict of the jury was in favor of plaintiff in the sum of $15,000. The trial court set the verdict aside and granted defendant a new trial. Plaintiff appealed.

Defendant’s motion to dismiss the appeal herein on the ground that plaintiff’s statement of the ease does not comply with the rules of this court was taken with the case. After duly considering tin's motion, we have concluded that the appeal should not be dismissed and accordingly overrule the motion.
