1Opinion of the Court

JERRE S. WILLIAMS, Circuit Judge:

Darnell Johnson filed suit under 42 U.S.C. § 1983 against the State of Texas, Grayson County, Texas, Tanya Marlatt, and Jonathan Kamras. His complaint alleged that he had been falsely imprisoned by the defendants, that he had been rein-dicted on a charge that had been dismissed for a speedy trial violation, and that the state had used perjured testimony against him. The district court ordered that Johnson’s suit be held in abeyance on the inactive docket until Johnson exhausted his ha-beas corpus remedies. Johnson filed a timely notice of appeal.
