*603In a subrogation action to recover benefits paid to the plaintiffs insured, the plaintiff appeals from so much of an order of the Supreme Court, Suffolk County (Molia, J.), dated February 1, 2008, as, after a hearing to determine the validity of service of process, granted that branch of the defendant’s motion which was pursuant to CPLR 5015 (a) (4) to vacate a judgment entered July 12, 2004, upon his default in appearing or answering the complaint.
Ordered that the order is affirmed insofar as appealed from, with costs.
