—In an action to recover damages for defamation, the defendants Merck & Co., Inc., and Harrison & Star, Inc., appeal from (1) an order of the Supreme Court, Suffolk County (Werner, J.), dated March 6, 2000, which denied their application for a subpoena duces tecum to compel the release of samples of the plaintiffs blood from two hospitals where they were stored, and (2) an order of the same court dated May 31, 2000, which granted that branch of the plaintiffs motion which was to impose a sanction on them for spoliation of evidence.
Ordered that the orders are affirmed, with one bill of costs.
