[1] The above named respondent Tolbert W. Hughes was charged in an information issued by the Prosecuting Attorney of the City of St. Louis and filed in the St. Louis Court of Criminal Correction with practicing medicine without having a license from the State Board of Medical Examiners. The trial court sustained the defendant's motion to quash the information and ordered that "the defendant be discharged and go hence without day." The order of discharge was entered on May 17, 1948, and on May 25, 1948, the State filed a motion for a new trial which was overruled on the same day. On May 26,…
