The defendant was convicted of the crime of the possession of narcotics as a felony upon verdict rendered by a jury in Kings County. He was thereafter sentenced on July 18, 1963 to a term of three to five years to run concurrently with a sentence imposed by another Justice of this court on June 21, 1963. Judgment of conviction was unanimously affirmed by the Appellate Division, Second Department on November 2, 1964 (People v. D’Iorio, 22 A D 2d 853).
