Appellant was charged by affidavit with violation of §40 of the act of 1925, as amended by the act of 1927 (Acts 1925 p. 570, Acts 1927 p. 562) forbidding the operation of a motor vehicle while under the influence of intoxicating liquor, and providing that, upon conviction, punishment shall be by fine of not more than $500, to which shall be added imprisonment in the county jail or state farm for a period of not less than thirty days nor more than six months.
