The principal error assigned on this record is in the refusal of the trial court to give to the jury certain instructions asked by plaintiff in error. At the close of the evidence of the plaintiff in the trial below, the defendant below moved the court to instruct the jury to find for defendant, which motion was renewed at the close of the argument, and by the court denied.
