Henderson, J.,

delivered the opinion of the Court.. On September 29, 1953, a jury in the Superior Court of Baltimore City rendered a. verdict in favor of the plaintiff, appellant here, in the amount of $3,250, representing damages for personal injuries sustained when the plaintiff was struck by an automobile driven by the defendant. On the same day judgment on the verdict nisi was entered. On October 1, 1953, the defendant filed a motion for a new trial on several grounds, the first of which was newly discovered evidence.
