W. C. HINES, Circuit Judge.

The appellant was charged with the offense of murder in the first degree and received a sentence of fifteen years in prison.

This appeal was brought from a judgment, based on a jury verdict finding the appellant guilty of murder in the second degree.

*314The first witness called by the State was Van Pruitt, identified as a State Toxicologist, who testified that on October 18, 1970, he performed a post mortem examination on Jesse Shrader, and found a wound approximately one inch above the middle brow of Mr. Shrader’s head.
