The action was brought upon the common counts. At the opening of the trial the plaintiff was permitted to file a substituted complaint in which it was alleged that, at the request of the defendant’s wife, the plaintiff sold and delivered necessaries for the support of the family in the form of groceries and meats, of a value of $333.46. The defendant appealed from the allowance of the amendment of the complaint on the ground that it was filed too late, and on the further ground that no one of the common counts was an appropriate statement of the cause of action alleged in the amendment.
