Motion by defendant for an order discharging of record a judgment entered against him and vacating an execution against his wages. Plaintiff opposes the application.

On January 16, 1956 a judgment was entered against the defendant in the sum of $50,189. On March 9, 1956 defendant filed a voluntary petition in bankruptcy in the United States District Court for the Eastern District of New York and vzas adjudicated a bankrupt. Plaintiff’s judgment was listed on the schedules in bankruptcy. On May 22, 1956 defendant was discharged by the Eeferee in Bankruptcy. The judgment herein was thereby…
