The defendant, Thelma K. Brown, was charged in an indictment presented and filed in the District Court of Oklahoma County with the crime of forgery in the second degree, it being alleged in the indictment that the accused did utter and pass a forged and counterfeit check in the amount of $77.57 to the Capital Finance Company which check bore the name of one Pauline Farris as endorser thereon, when in truth and in fact the said Pauline Farris was ■a fictitious person etc.; was tried and con victed but the jury being unable to agree upon the punishment, left the same to be fixed by…
