OPINION OF THE COURT
Lawton, J.
This CPLR article 78 proceeding was commenced to annul the determination of respondent Chief of Police of the City of Syracuse to terminate petitioner from his position as a police officer with the City of Syracuse and for an order restoring *162him to the rolls of the police department with back pay.* Petitioner has appealed from a judgment of Supreme Court denying the relief sought in the petition. The judgment, however, stayed the removal of petitioner from his employment pending determination of this appeal.
