delivered the opinion of the Commission of Appeals, Section A.

This suit was instituted in one of the district courts of Dallas County by defendant in error, Mrs. L. A. Joiner, against plaintiff in error, C. M. Joiner, sometime about the 1st of January, 1934. The parties will be referred to as in the trial court.

Plaintiff’s suit was to recover a one-half interest in a considerable estate, situated mostly in the State of Texas, consisting of both real and personal property. The title to these properties was in the name of defendant or in the names of other persons as trustees…
