Appellant, Jean Henry, instituted this suit in a district court of Dallas County against appellee, Publix Theatres Corporation, to recover damages for personal injuries received while attending a moving picture performance in the Palace Theatre, a building operated by appellee. At the conclusion of appellant's testimony, the jury returned a verdict in favor of appellee under peremptory instruction by the court. Appellant has duly prosecuted an appeal to this court.
