This is an appeal by the Director of Finance and the State Treasurer from a decree of the circuit court of Sangamon county enjoining the director from paying to the Treasurer and the Treasurer from receiving, and requiring the director to refund to the Richardson Lubricating Company certain moneys paid by it to the Department of Finance as taxes on the sale and distribution of motor fuel under the Motor Fuel Tax act of 1927, which was held unconstitutional in Chicago Motor Club v.
