(2d) 141, and in an opinion by the Commission of Appeals in answer to certified questions in 116 Tex. 253, 288 S. W. 425. The appellees are Arthur V. Williams and his parents, but where the word “appellee” is used in this opinion it will refer to Arthur V. Williams only. After the case was remanded in accordance with the opinion of this court, appellee, amended his petition, alleging that he had reached the age of 21 years, and suing in his own name instead of by next friend.
