Appeal from a judgment of the Oneida County Court (Michael *1319L. Dwyer, J.), rendered April 20, 2004. The judgment convicted defendant, upon a jury verdict, of attempted murder in the first degree, assault in the second degree, criminal possession of a weapon in the second degree, criminal possession of a weapon in the third degree and false personation.

It is hereby ordered that the judgment so appealed from be and the same hereby is unanimously affirmed.
