The present matters before the court are cross motions for summary judgment filed by JPMorgan Chase Bank, N.A., Co-mar Marine, LLC, and Superior Shipyard & Fabrication, Inc. These partial motions for summary judgment address whether the administrative expense claimants named as defendants are entitled to surcharge collateral that secures Chase’s preferred ship mortgage and which allegedly secures Comar’s claim.
